According to paragraph 2 of part 4 of Article 14 of the Law of Ukraine "On Public Procurement," in the requirements for the subject of procurement that contain references to a specific trademark or company, patent, design, or type of procurement item, its source or manufacturer, the procuring entity may specify which analogues and/or equivalents are accepted in the participants' bids. That is, the law establishes the right, not the obligation, for the procuring entity to indicate which analogues and/or equivalents are accepted in participants' bids. In order to reduce the multi-brand nature of vehicles, in accordance with the order of the Ministry of Defense of Ukraine dated 01.07.2002 No. 219 “On Approval of the Manual for the Operation of Automotive Equipment in the Armed Forces of Ukraine”, taking into account the norms of Part 4 of Article 14 of the Law “On Public Procurement”, the subject of procurement in the Announcement for simplified procurement is determined with the condition of a specific manufacturer and model, since the operation of such a product satisfies the needs of the customer in terms of technical and quality characteristics, as well as in terms of life cycle cost. Therefore, equivalents of the product were not determined and in the event of their proposals, it will be considered that the product does not meet the requirements for the subject of procurement. Your accusations are baseless.
