Враховуючи, що ПрАТ «КЕЗ «Транссигнал» не є замовником у розумінні Закону України "Про публічні закупівлі" (далі - Закон), оскільки є юридичною особою, що не відповідає критеріям, визначеним у статті 2 Закону, однак використовує електронну систему закупівель для закупівлі товарів, робіт та послуг, дана закупівля здійснюється відповідно до порядку проведення закупівлі товарів, робіт та послуг ПрАТ «КЕЗ «Транссигнал», затвердженого рішенням акціонера ПрАТ «КЕЗ «Транссигнал» від 13.02.2024 № 1/7/24 (далі – Порядок), із застосуванням електронної системи закупівель, веб-порталу Уповноваженого органу у сфері публічних закупівель, у тому числі, функціоналу, передбаченого для спрощених закупівель, і в порядку, визначеному статтею 14 Закону з урахуванням особливостей, встановлених Порядком, але в будь-якому випадку не підпадає під дію Закону.

1. Lack of Substantive Inquiry Your latest submission fails to provide any information, technical queries, or legal grounds pertaining to the subject matter of this procurement. In accordance with the Procedure for the Procurement of Goods, Works, and Services of PrJSC "KEZ "Transsignal" (approved by the Shareholder’s Resolution dated February 13, 2024, No. 1/7/24), only inquiries directly related to the merits of the tender documentation and procurement process are subject to formal review.
As your message contains no relevant information, it cannot and will not be processed in accordance with the established procurement protocols.
2. Documentation of Continued Misconduct Be further advised that the content of your latest communication has been formally documented and appended as supplementary evidence to the previously initiated case files regarding undue pressure, unprofessional conduct, and cyber-security risks.
This additional record will be forwarded to the following authorities to complete the comprehensive assessment of your activities:
The Cyber Police Department of the National Police of Ukraine;
The Security Service of Ukraine (SBU);
The Internal Security and Risk Management Units of JSC "Ukrzaliznytsia".
3. Conclusion of Communication The Customer reserves the right to terminate any further correspondence that does not meet the legal and ethical requirements of the procurement process as defined by the Procedure and the Laws of Ukraine.

Official Notice Regarding Unprofessional Conduct and Security Violations
To the Participant,
The Customer hereby formally addresses your communication dated January 29, 2026. Your inquiry, characterized by unprofessional language and derogatory terminology, is deemed unacceptable and is treated as an attempt to exert undue pressure on the Authorized Person of the Customer.
1. Legal Inviolability of the Electronic Document The document "ТД_електродвигуни.pdf" is the primary and sole legally binding version of the Technical Requirements. In accordance with the legislation of Ukraine:
«Електронний документ — документ, інформація в якому зафіксована у вигляді електронних даних, включаючи обов’язкові реквізити документа» (ст. 5 Закону України «Про електронні документи та електронний документообіг»).
«Кваліфікований електронний підпис має таку саму юридичну силу, як і власноручний підпис, та має презумпцію відповідності власноручному підпису» (ч. 4 ст. 18 Закону України «Про електронну ідентифікацію та електронні довірчі послуги»).
Demanding the publication of official requirements in an unsecured, editable format (such as Microsoft Word) is a direct request to compromise the integrity of the procurement process. Such actions contradict the principles of data non-repudiation and document authenticity.
2. Cybersecurity and Threat Assessment Your persistent demands to deviate from secure, signed PDF formats to editable files exhibit signs of targeted interference with the Customer’s electronic systems. Under the Law of Ukraine "On the Basic Principles of Ensuring Cybersecurity of Ukraine", such activities are classified as potential cyber-threats aimed at compromising official data.
3. Jurisdictional Actions Due to the aggressive nature of your communication and the signs of psychological pressure and cyber-danger, the Customer has initiated the following protocols:
A formal report is being prepared for the Cyber Police Department of the National Police of Ukraine.
Information regarding this incident will be forwarded to the Security Service of Ukraine (SBU) and the Prosecutor General’s Office for investigation into potential attempts to sabotage the procurement process.
The Internal Security Units of JSC "Ukrzaliznytsia" have been notified of this security breach and the unprofessional conduct of a potential participant.
Any further communication from your side must strictly adhere to the standards of international business ethics and the legal framework of Ukraine.

Dear Participant,
We appreciate your interest in this procurement process. Regarding your request to provide technical requirements in an editable format, please consider the following legal and technical positions of the Customer:
1. Regulatory Framework Please be advised that PrJSC "KEZ "Transsignal" does not qualify as a "contracting authority" (customer) within the meaning of the Law of Ukraine "On Public Procurement" (hereinafter – the Law).
This simplified procurement is conducted pursuant to the "Procedure for the Procurement of Goods, Works, and Services of PrJSC 'KEZ 'Transsignal'", approved by the Shareholder’s Resolution dated February 13, 2024, No. 1/7/24 (hereinafter – the Procedure). While this process utilizes the electronic procurement system and the functionality prescribed for "simplified procurements" under Article 14 of the Law, it is governed by the provisions of the Procedure and remains outside the jurisdiction of the Law itself.
2. Document Integrity and Legal Status The tender documentation, including all technical, qualitative, and quantitative specifications, is set forth in the file "ТД_електродвигуни.pdf". This file is an official electronic document under Ukrainian law and bears the qualified electronic signature (QES) of the Customer's Authorized Person.
In accordance with established data integrity protocols, any modification to the file (including changes to its extension, format, or hash sum) may result in a technical failure and compromise the ability to verify the document’s authenticity. You may verify the integrity and the electronic signature of the document at the following official portal: https://czo.gov.ua/verify.
3. Compliance and Amendments All participants and their respective proposals must strictly adhere to the requirements stipulated in the documentation and the procurement announcement. Any discrepancy shall constitute grounds for the rejection of the proposal.
However, acknowledging your request, please be informed that should it be deemed necessary, the Customer may formalize and upload appropriate amendments to the tender documentation in due course to facilitate the procurement process.
