Розрахунки за надання послуг проводяться у безготівковій формі шляхом перерахунку коштів на рахунок Виконавця на наступних умовах: - за послуги з навчання користувачів програмним забезпеченням, що забезпечує виявлення витоків на конденсатопроводах включає в себе такі етапи як конфігурація, адаптація програмного продукту та проведення тестування та навчання користувачів: 70% попередня оплата протягом 30 календарних днів з дати отриманого рахунку на підставі укладеного договору за умови надання банківської гарантії повернення авансового платежу; решта 30% - по факту надання послуг протягом 30 календарних днів з дати підписання Акту прийманняпередачі наданих Послуг на підставі отриманого рахунку на оплату; - за послуги з надання права на користування програмним забезпеченням, що забезпечує виявлення витоків на конденсатопроводах на правах підписки: щоквартальні платежі по факту надання Послуг з оплатою протягом 30 (тридцяти) календарних днів з дати підписання Сторонами відповідного квартального Акту приймання-передачі наданих Послуг та отримання рахунку на оплату. Замовником встановлена вимога оформлення банківської гарантії повернення авансового платежу відповідно до умов додатку №8.1 до тендерної документації.

Our global business bank HSBC have advised they do not have any direct swift links with any of the banks listed on your tender document.
They can route it through another UK bank if you can provide details of one which has known swift links with your preferred receiving bank?
We have investigated as many alternatives as possible.

We would like to request an extension to the submission deadline of two weeks as the tender security guarantee is taking longer than expected due to limited communication from the Ukrainian banks specified in the tender documentation. We have all other documents and proposal ready for submission but the portal clearly states that the tender security guarantee must be in place in order to make a bid. We are doing everything in our power to get the guarantee in place as soon as possible. We would appreciate a prompt response.

We can provide a tender security guarantee through our main bank HSBC. To enable this to be down through swift, our bank HSBC require details of a bank provided by you which they can use as an intermediary. This must have with swift links to both HSBC UK and your relevant local Ukrainian bank through the intermediary.
Is it possible to provide these details?

Відповідно до умов тендерної документації предметом закупівлі є «Надання права користування програмним забезпеченням, що забезпечує виявлення витоків на конденсатопроводах на правах підписки, та навчання користувачів». Водночас у Додатку 4 п.4.2.2.1 вказано наступне: «Забезпечити поставку та встановлення власного обладнання для досягнення показників зазначених в Додатку №2 до Договору без нарахування додаткової оплати за його монтаж та використання».
Просимо надати роз’яснення щодо випадку із потенційною поставкою обладнання:
1. Яким чином Замовник передбачає оформлення передачі такого обладнання, якщо воно має бути встановлене учасником: чи переходить обладнання у власність замовника; чи залишається у користуванні учасника протягом всього строку дії договору; яким чином відображається така передача у договірних відносинах та бухгалтерському обліку зважаючи на те що Додаток 4 являється проєктом договору на надання послуг?
2. Яким чином будуть виконуватись роботи з встановлення додаткового обладнання у вибухонебезпечних або технічно складних зонах і хто буде відповідальний за: отримання дозволів на виконання робіт підвищеної небезпеки; проведення земляних, монтажних чи електромонтажних робіт; проектування та погодження технічних рішень у зоні дії чинних інженерних комунікацій.

1. Предметом закупівлі є послуги з надання права на користування програмним забезпеченням, що забезпечує виявлення витоків на конденсатопроводах на правах підписки та навчання користувачів. У випадку, якщо технічне рішення Виконавця по Договору передбачає встановлення додаткового обладнання Виконавець має забезпечити поставку та встановлення власного обладнання для досягнення показників зазначених в Додатку №2 до Договору без нарахування додаткової оплати за його монтаж та використання.
Оформлення передачі такого обладнання, якщо воно має бути встановлене відбуватиметься шляхом підписання Сторонами акту встановлення такого обладнання. Обладнання залишається у власності Виконавця. Обладнання перебуває у користуванні Замовника протягом строку надання послуг по договору
2. Встановлення додаткового обладнання у вибухонебезпечних або технічно складних зонах, у разі необхідності, здійснюється Виконавцем згідно вимог діючих нормативних документів та чинного законодавства України, що встановлені до робіт такого виду, в точу числі в галузі охорони праці та промислової безпеки.

Дякуємо за звернення, стосовно вашого питання повідомляємо наступне.
Отримання Замовником гарантії забезпечення тендера кур’єрською службою (DHL) не передбачено умовами тендерної документації. Відповідно до п.6 Розділу І тендерної документації банківська гарантія подається учасниками у складі тендерної пропозиції закупівлі через електронну систему закупівель. Форма надання банківської гарантії для іноземних банків: у електронній формі автентичним свіфт-повідомленням на свіфт-адресу банка бенефіціара (Замовника), при цьому до складу тендерної пропозиції додається сканкопія такого свіфт-повідомлення з текстом банківської гарантії.

The terms of the Tender Documents do not provide for receiving the tender security guarantee by the Customer via courier service (DHL).
In accordance with paragraph 6 of Section I of the Tender documents, the Bidder submits the bank guarantee as part of the Tender Offer through the electronic procurement system.
Bank guarantee provision by foreign banks: in electronic form, by authentic SWIFT notification to the Swift address of the beneficiary's (Customer's) bank, while a scan copy of such SWIFT notification with the text of the bank guarantee is attached to the tender offer.

Доброго дня! Дякуємо за звернення. стосовно Вашого питання повідомляємо наступне:
Гарантія може бути надана у міжнародній валюті (євро або долар США) по курсу НБУ на дату оголошення закупівлі в електронній системі закупівель згідно форми, що наведена у додатку №8 до тендерної документації.
Для іноземних банків банківська гарантія надається у електронній формі автентичним Swift-повідомленням на свіфт-адресу банка бенефіціара (інформація про банки Бенефіціара надана в пункті 6 Розділу І Тендерної документації). У випадку використання свіфт-повідомлення, сканкопія відповідного свіфт-повідомлення з текстом банківської гарантії повинна бути завантажена учасником в електронну систему закупівель до закінчення строку подання тендерних пропозицій.
Зверніть увагу, що до тендерної документації були внесені зміни, тому забезпечення тендерної пропозиції має враховувати внесені зміни та відповідно частина «Інформація щодо тендерної документації» забезпечення тендерної пропозиції має містити посилання на дату рішення замовника, яким затверджена остання редакція тендерної документації.

The guarantee can be provided in an international currency (euros or US dollars) at the NBU exchange rate as at the date of the announcement in the electronic procurement system; the guarantee must comply with the template given in Appendix No. 8 to the tender documents.
For foreign banks, the bank guarantee is submitted in electronic form by an authentic Swift-notification to the beneficiary's bank's Swift address (information about the Beneficiary's bank is provided in paragraph 6 of Section I of the Tender documents). If a swift notification is used, the bidder shall upload a scan-copy of the corresponding swift-notification with the bank guaranty wording to the electronic procurement system before the deadline for submitting bids.
Please pay your attention, that if changes were made to the tender documents, the tender offer security shall take into account the changes made and, accordingly, the part "Information on tender documents" of the tender offer security shall contain a reference to the date of the customer's decision that approved the latest version of the tender documents.

It is necessary to clarify who is responsible for the configuration, support, and maintenance of the existing IT/OT/SCADA systems, as well as for organizing the data transfer to the leak detection software. Who will be responsible for supporting the interfaces and integration points during the project implementation (including within the scope of technical support)?
The technical requirements specify proposed software must be installed in a VMware virtualized environment. Do these computing resources belong to the Customer’s existing infrastructure? Who is responsible for their deployment, installation of the leak detection software, further scaling, and technical support?

Will the Contractor be provided with condition reports for the Customer’s existing measurement equipment including: the date of the most recent calibration; a technical condition certificate or inspection report; confirmation of compliance with the original technical specifications?
Will a technical audit of the existing measurement equipment be carried out during the implementation phase of the project? If so, who will be responsible for its execution, and what is the expected scope?
Is there an established process for verifying and confirming the technical readiness of the Customer’s infrastructure for integration with the new software solution?

2. Технічний аудит та обслуговування вимірювального обладнання виконується силами Замовника на регулярній основі.
3. Інфраструктура по збору та обробки даних в SCADA наявна та функціонує, отже технічна готовність присутня. Згідно технічних вимог: «Замовником надається інфраструктура для розгортання ПЗ, що забезпечує виявлення витоків на конденсатопроводах та дані зі SCADA.»
4. Існуюче обладнання зазначене в технічних вимогах. Замовник відповідає за його працездатність. У разі виходу з ладу існуючого обладнання, наведеного в технічних вимогах, Замовник відповідає за його ремонт чи заміну на еквівалентне. 4. The existing equipment is specified in the technical requirements. The Customer is responsible for its operability. In the event of a failure of the existing equipment specified in the technical requirements, the Customer is responsible for its repair or replacement with an equivalent one. If the technical solution proposed by the Participant provides for the need to install additional equipment to achieve the indicators specified in Appendix No. 3 to the tender documentation, the Participant ensures the supply and installation of such equipment without charging additional fees for its installation and use (i.e. the Participant includes the cost of such equipment in the cost of services).

Since the successful implementation of the software largely depends on the technical readiness of the Customer’s existing infrastructure (measurement instruments, server equipment, network infrastructure, communication channels, and the SCADA/SAP/ERP systems), we kindly request clarification on the following points:
1) What specific obligations does the Customer have regarding the preparation and configuration of the existing infrastructure to ensure its compatibility with the implemented software?
2) Who is responsible for identifying and resolving any deficiencies or limitations of the existing infrastructure that may be discovered during the course of the project?
3) Is the Customer financially liable for any delays or additional costs incurred by the Contractor due to the improper or untimely preparation of the existing infrastructure?

- Справність зазначених у Додатку №3 до тендерної документації вимірювальних приладів
- Наявність та працездатність каналів передачі даних, серверного обладнання, мережевої інфраструктури для передачі даних до SCADA- системи і від SCADA до програмного забезпечення, що забезпечує виявлення витоків на конденсатопроводах.
- Підготовку даних зі SCADA-системи до програмного забезпечення, що забезпечує виявлення витоків на конденсатопроводах.
2) У разі виходу з ладу обладнання Замовника – усунення відбувається силами Замовника..

The current timeframe of two weeks is insufficient to carry out a thorough analysis of the tender documentation, contractual conditions, and potential risks, as well as to prepare a comprehensive and well-founded offer. Preparing a reliable bid requires adequate time for internal consultations, cost estimation, and ensuring full compliance with all requirements set forth in the tender documents.
