As now it is a weekend, and you may make amendments on Monday only, please extend the date of closing to June 6 without extending delivery time.

Доброго дня. Щодо Вашого звернення повідомляється наступне:
Розпис бюджету - документ, в якому встановлюється розподіл доходів, фінансування бюджету, повернення кредитів до бюджету, бюджетних асигнувань головним розпорядникам бюджетних коштів за певними періодами року відповідно до бюджетної класифікації.
Бюджетне асигнування - повноваження розпорядника бюджетних коштів, надане відповідно до бюджетного призначення, на взяття бюджетного зобов'язання та здійснення платежів, яке має кількісні, часові та цільові обмеження бюджетної класифікації.
Розподіл показників зведених кошторисів, розподіл показників бюджетних асигнувань, план асигнувань загального фонду бюджету на 2025 рік для Управління державної охорони України доведено та затверджено 27.12.2024.
Процес обслуговування державного бюджету за видатками забезпечується Державною казначейською службою України (наказ Міністерства фінансів України від 24.12.2012 №1407).
Відкриті асигнування - право, надане головним розпорядникам бюджетних коштів та розпорядникам бюджетних коштів нижчого рівня, щодо розподілу виділених асигнувань загального та спеціального фондів державного бюджету підвідомчим установам (одержувачам бюджетних коштів) та використання бюджетних асигнувань з урахуванням узятих на облік бюджетних зобов'язань. Відкриті асигнування забезпечуються ресурсами єдиного казначейського рахунка (наказ Міністерства фінансів України від 24.12.2012 №1407).
Отже, «затримка бюджетного фінансування» - про недостатність ресурсу на єдиному казначейському рахунку та неможливість Державної казначейської служби України своєчасного відкриття асигнувань головним розпорядникам для виконання взятих бюджетних зобов’язань а не про відсутність розподілу бюджетних коштів.

The distribution of indicators of consolidated estimates, the distribution of indicators of budget appropriations, the plan of appropriations of the general fund of the budget for 2025 for the State Security Department of Ukraine was approved and approved on 12/27/2024.
The process of servicing the state budget by expenditures is provided by the State Treasury Service of Ukraine (order of the Ministry of Finance of Ukraine dated 12/24/2012 No. 1407).
Open appropriations - the right granted to the main spending units of budget funds and lower-level spending units of budget funds to distribute the allocated appropriations of the general and special funds of the state budget to subordinate institutions (recipients of budget funds) and use budget appropriations taking into account the budget obligations taken into account. 1. Відповідно до додатку 2 до тендерної документації, предметом закупівлі є шолом кулезахисний в комплекті з окулярами балістичними. Помилки там немає, тому наразі стосовно цього зміни вноситися не будуть.

Відповідно до абзацу 4 пункту 49 розділу «Порядок проведення відкритих торгів» Особливостей ПКМУ 1178 «Про затвердження особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України “Про публічні закупівлі”, на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування» від 12.10.2022, а саме: Замовник укладає договір про закупівлю з учасником, який визнаний переможцем процедури закупівлі, протягом строку дії його пропозиції, не пізніше ніж через 15 днів з дати прийняття рішення про намір укласти договір про закупівлю відповідно до вимог тендерної документації та тендерної пропозиції переможця процедури закупівлі. У випадку обґрунтованої необхідності строк для укладення договору може бути продовжений до 60 днів. У разі подання скарги до органу оскарження після оприлюднення в електронній системі закупівель повідомлення про намір укласти договір про закупівлю перебіг строку для укладення договору про закупівлю зупиняється.
Зважаючи на зазначене, у переможця відкритих торгів з особливостями є що найменш 15 днів та ще 2 дні після укладання Договору щоб надати зразки для затвердження. Тому з цього приводу зміни вноситися не будуть.

In case of justified necessity, the term for concluding a contract may be extended to 60 days. We have interest to bid on this tender from one our associated manufacturers in China and started preparing documents. But we faced the unnecessary term, which makes this deal impossible for Chinese. If you are not targeting only domestic bidder (maybe, a friend...), we kindly ask you to understand and correct:
1. You ask for notarization and apostille translation of all documents. Do you know how it works? It should be either made in Ukrainian consulate in Beijing or by certified notarial translator and then added apostille in the High Court in Beijing. Can you imagine how long it takes? Minimum a month. Do you think that your small tender makes seller so much motivated to force all in two days? Absolutely not. We have contacted all manufacturers in the world except UA, RU, BY, IR, DRK (about 200). NOBODY WAS INTERESTED except that one. So, we need your correction of terms. Replace in Appendix 2 words "... translation into Ukrainian language, certified notarized or apostille" with words "... translation into Ukrainian language." We run over five hundred tenders a year on PROZORRO for our associates and nobody asks to apostille till now. We translate documents to Ukrainian ourselves as have Native Ukrainians in our staff and certify with our seal of US company. If you don't accept this term - we cannot help.
2. The time limits are too short, even if you make the amendment as above. Theoretically it is possible to make it all within three days. But the seller must be VERY motivated. But your tender is small. So, motivation is only for regular work. Please extend the tender closing date for three more days without extension of delivery time. So, it will have no difference for you.

1. Ви просите нотаріальне засвідчення та апостилювання всіх документів. Чи знаєте ви, як це працює? Це має бути зроблено або в українському консульстві в Пекіні, або у сертифікованого нотаріального перекладача, а потім додано апостиль у Високому суді Пекіна. Чи можете ви уявити, скільки часу це займає? Мінімум місяць. Чи вважаєте ви, що ваш невеликий тендер настільки мотивує продавця, щоб змусити все це за два дні? Абсолютно ні. Ми зв'язалися з усіма виробниками світу, окрім UA, RU, BY, IR, DRK (близько 200). НІХТО НЕ ЗАЦІКАВИВСЯ, окрім цього одного. Тому нам потрібна ваша корекція термінів. Замініть у Додатку 2 слова "... переклад українською мовою, засвідчений нотаріально або апостиль" словами "... переклад українською мовою". Ми проводимо понад п'ятсот тендерів на рік на PROZORRO для наших партнерів, і ніхто досі не просить апостилювати. Ми самі перекладаємо документи українською мовою, оскільки в нашому штаті є корінні українці, і засвідчуємо їх печаткою нашої американської компанії. Якщо ви не погоджуєтеся з цим терміном - ми не можемо допомогти.
2. Терміни занадто короткі, навіть якщо ви внесете вищезазначену поправку. Теоретично можливо зробити все протягом трьох днів. Але продавець повинен бути ДУЖЕ мотивованим. Вимога щодо перекладу документів українською мовою, завірених нотаріально або апостилем, є обґрунтованою в контексті забезпечення правової чистоти та підтвердження автентичності документів. Вона відповідає вимогам чинного законодавства України та міжнародним стандартам, зокрема нормам, що регулюють переклади документів для офіційного використання. Нотаріальне завірення або апостиль забезпечує визнання документа в межах законодавства і дозволяє зберегти юридичну силу документа у випадку подальшого його використання. Відповідно до пункту 34 розділу «Порядок проведення відкритих торгів» Особливостей ПКМУ 1178 «Про затвердження особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України “Про публічні закупівлі”, на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування» від 12.10.2022, Строк для подання тендерних пропозицій не може бути менше ніж:
сім днів з дня оприлюднення в електронній системі закупівель оголошення про проведення відкритих торгів на закупівлю товарів, послуг;
14 днів з дня оприлюднення в електронній системі закупівель оголошення про проведення відкритих торгів на закупівлю робіт.
Тому зважаючи на зазначене Замовник не порушує терміни проведення відкритих торгів з особливостями, та наразі вноситись зміни стосовно цього питання не будуть.
