Опис: Question 1: Since certificates for knowledge in software tools (PSS/E, DigSilent,…) are in English and have international purpose and meaning, is it necessary to translate them into Ukrainian? Question 2: Does the statement of foreign bidder, signed by the authorized person of the bidder, acceptable to the contracting authority (the statement that the bidder has not violated Articles 6 and 50 of the Ukrainian Law "Про захист економiчноï конкуренцiï" in the last three years)? Does such a statement completely meet the requirements 4.2. (Sections I, Appendix 2) of the tender documentation? Question 3: Does the statement of foreign bidder, signed by the authorized person of the bidder, acceptable to the contracting authority (the statement that the bidder is not registered in the Unified State Register of legal entities who committed corruption or corruption-related offenses)? Does such a statement completely meet the requirements 4.3. (Sections I, Appendix 2) of the tender documentation?
Відповідь: По першому питанню Так, сертифікати повинні містити переклад на українську мову. Відповідно до вимог пункту 7 Розділу 1 тендерної документації «Під час проведення процедур закупівель всі документи, що готуються учасником та замовником, викладаються українською мовою. Документи викладені іншою іноземною мовою, повинні мати автентичний переклад на українською мову.» По другому та третьому питанню Відповідно до вимог пункту 5 Розділу 1 тендерної документації «Учасники - нерезиденти для виконання вимог щодо подання документів, передбачених Додатком 2 документації подають документи, передбачені законодавством держави, де вони зареєстровані з відповідними поясненнями: - у разі подання аналогу документу або у разі відсутності такого документу та його аналогу, учасник-нерезидент повинен додати пояснювальну записку з посиланням на нормативно-правові акти держави, резидентом якої він є; - у разі якщо законодавством держави, де зареєстрований учасник-нерезидент, не передбачено надання відповідних документів, учасник надає лист – роз’яснення, в якому зазначає законодавчі підстави ненадання документів, передбачених Додатком 2 тендерної документації». The answer to the first question Yes, сertificates must contain a translation into Ukrainian. In accordance the requirements of clause 7 of section 1 of tender documentation "During the procurement of all documents prepared by the participant and the customer, are taught in Ukrainian. The documents are set out in a different foreign language, must have an authentic translation into the Ukrainian language." The answer on the second and third question In accordance with the requirements of paragraph 5 of section 1 of the tender documentation, "Participants - non-residents for the purpose of fulfilling the requirements for submission of documents specified in Appendix 2 of this documentation submit documents provided by the legislation of the state where they are registered with the relevant explanations: - in the case of submission of an analogue of the document or in the absence of such a document and its analogue, a non-resident participant must attach an explanatory note referring to the normative legal acts of the state of which he is a resident; - if the legislation of the state in which the non-resident participant is registered does not provide for the submission of the relevant documents, the participant shall submit a letter of explanation stating the legal grounds for refusing to provide the documents provided for in Appendix 2 of the tender documentation.
