Re. PROTOCOL Rejection of the bidder's proposal is pre-threshold. № 18T-200 dd. July 03, 2018 (PAC HV) Dear Mr. Razdobarin, Akzo Nobel Chemicals S. p.A. Novara Italy expresses our respect to you and by this letter, we are applying with the request of re-testing the Valpac R (PAC HV) sample in the framework of procurement procedures of PJSC “Ukrgazvydobuvannia”: 18T-200, 24960000-1 - Chemical products (Polyanionic cellulose High Viscosity - PAC HV). Based on the Protocol of Rejection of the bidder's proposal is pre-threshold published on 03.07.2018, our company was disqualified (withdrawn from participation) in the tender for the supply of PAC HV due to the adequate viscosity of the Valpac R sample provided does not meet the technical requirements of the tender documentation, which was previously stated in the memo of the Drilling Department of PJSC “Ukrgazvydobuvannia” dated 21.06.2018, No.12.1.1/828-S based on laboratory results. Our company has sent 2 samples of 0.5 kg each to the address of the FBU "Ukrburgas" and UkrNDIgas for testing in accordance to international standard API/ISO 13500 and the technical part of the tender documentation of PJSC “Ukrgazvydobuvannia” requirements of which repeat the above standard. The control sample from the same batch is stored in the production laboratory of our company in Novara Italy. Based on information stated in Protocol, AkzoNobel Chemicals S. p.A in the production laboratory in Novara Italy has been re-tested the control sample of Valpac R (PAC HV) for compliance with the international standard API/ISO 13500 applied to Polyanionic Cellulose. The test results confirmed the full compliance of the sample with the requirements of the standard on the indicators: Apparent Viscosity (52 mPa*s) and Fluid Loss (18ml). We assume that in the conditions of two laboratories / testing centers of the FBU "Ukrburgaz" and UkrNDIgaz the received results of the presented samples could not obtain similar indications, moreover, a large discrepancy in the indicators of the Apparent Viscosity during testing could occur due to not full dissolution of Valpac R (PAC HV) in the solution that was tested and obtained a negative result, which is a violation of the method of preparation of the tested solutions. Our company does not agree with the decision of Central Disputes Committee and the recommendation to disqualify our company. We turn to you with a request to re-test the sample of Valpac R (PAC HV) in two testing centers for cross checking of the results.
