Вирішення: У відповідь на Вашу вимогу повідомляємо, що Замовник проводить закупівлю керуючись нормами ЗУ «Про публічні закупівлі» та з урахуванням Особливостей. Відповідно до чинного законодавства, а саме пункту 34 постанови Кабінету Міністрів України від 12 жовтня 2022 року № 1178 «Про затвердження Особливостей здійснення державних закупівель товарів, робіт і послуг для замовників, передбачених Законом України «Про публічні закупівлі», на період дії режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування» строк подання тендерних пропозицій не може бути меншим семи днів з дня оприлюднення оголошення про проведення відкритих торгів в електронній системі закупівель. Строк для подання тендерних пропозицій за даною закупівлею становить сім днів, що відповідає вимогам чинного законодавства. Враховуючи вищевикладене, підстави для задоволення вимоги відсутні. In response to your demand, we inform you that the Customer conducts the procurement in accordance with the provisions of the Law of Ukraine "On Public Procurement" and taking into account the Specifics. In accordance with the current legislation, namely clause 34 of the Resolution of the Cabinet of Ministers of Ukraine of October 12, 2022 No. 1178 "On approval of the specifics of public procurement of goods, works and services for customers provided for by the Law of Ukraine "On Public Procurement", for the period of validity the regime of martial law in Ukraine and within 90 days from the date of its termination or cancellation", the term for submitting tenders cannot be less than seven days from the date of publication of the announcement of open tenders in the electronic procurement system. The deadline for submitting tenders for this procurement is seven days, which meets the requirements of current legislation. Considering the above, there are no grounds for meeting the demand.
